Terms of Service

1. Who may use Beam

You must be at least 13 years old to use the Service, and old enough to form a binding contract in your jurisdiction. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian. By using Beam you represent that you meet these requirements.

2. What Beam is

Beam is a general-purpose tool that helps you retrieve media that is already publicly accessible on the internet. Beam does not host, store, cache, or distribute any media content. It does not maintain a library of files. It acts only at your direction, on a link you provide, to help you obtain a copy of content for which you are responsible.

3. Your responsibilities

You are solely responsible for how you use the Service. In particular, you agree that:

• You will only download content that you own, that is in the public domain, or that you have explicit permission from the rights holder to download.
• You are solely responsible for determining whether your use of any content is lawful, and for any copyright, trademark, privacy, or other rights associated with that content.
• You will comply with all applicable laws and with the terms of service of any third-party platform from which you obtain a link (for example YouTube, Instagram, Facebook, X, or Reddit).
• You will not use the Service to infringe the intellectual property or privacy rights of any person.
• You will not use the Service to access, retrieve, or circumvent any content that is private, confidential, paywalled, age-restricted, or protected by a login, password, digital rights management, or other technical or access-control measure that you are not authorized to bypass.
• You will not use the Service to download content depicting minors inappropriately, or any content that is unlawful, defamatory, or that violates the rights or privacy of any person.
• You assume all risk arising from your use of the Service and from any content you choose to download. You, and not Dhrunova, are responsible for any consequences of that use.

4. Not affiliated with any platform

Beam and Dhrunova are independent. We are not affiliated with, endorsed by, sponsored by, or connected to YouTube, Google, Instagram, Meta, Facebook, X (formerly Twitter), Reddit, or any other platform. All product names, logos, and trademarks are the property of their respective owners and are used for identification only.

5. Pro subscriptions and payments

Some features are offered through a paid subscription ("Beam Pro"). Payments are processed by our third-party payment provider. By purchasing a subscription you authorize us and our payment provider to charge your chosen payment method on a recurring basis until you cancel. You can cancel at any time, and cancellation takes effect at the end of the billing period you have already paid for. Except where required by law, payments are non-refundable.

6. Acceptable use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. We may suspend or terminate access for any user who abuses the Service, violates these Terms, or uses the Service unlawfully.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content you obtain through it will be accurate or lawful for your use.

8. Limitation of liability

To the maximum extent permitted by law, Dhrunova and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

9. Indemnification

You agree to indemnify and hold harmless Dhrunova and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or used the Service in a way that could cause harm or legal liability. You may stop using the Service at any time.

11. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. Because Beam does not host or store content, the appropriate remedy for most copyright concerns is with the platform that hosts the content. Where a valid notice applies to us, we respond in accordance with our DMCA Policy, which is incorporated into these Terms by reference. We reserve the right to restrict or terminate, in appropriate circumstances and at our discretion, the access of any user who is the subject of repeated infringement notices.

12. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to the following, the courts located in India will have exclusive jurisdiction over any dispute not subject to arbitration.

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, and not in a class, collective, or representative proceeding. You and Dhrunova each waive any right to a jury trial and any right to participate in a class action. If any part of this waiver is found unenforceable, the remainder of this section still applies. Nothing here prevents either party from seeking injunctive relief for intellectual-property or unauthorized-access matters in a court of competent jurisdiction.

13. General

These Terms, together with the Acceptable Use Policy, DMCA Policy, and Privacy Policy, are the entire agreement between you and Dhrunova regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be limited or removed to the minimum extent necessary. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
